Terms of Use

These terms govern your use of the TextCalm AI application, published by Thibault Demars. By using the application, you agree to these terms. They supplement, without replacing, the applicable Apple App Store or Google Play terms.

If you downloaded TextCalm AI from Apple's App Store, the application is also licensed to you under Apple's Standard Licensed Application End User License Agreement. These TextCalm Terms of Use govern the TextCalm service and supplement Apple's Standard EULA. Nothing in either document limits mandatory consumer rights that cannot legally be excluded.

1. Service description

TextCalm AI uses artificial intelligence to analyse submitted messages and help users step back from ambiguous or stressful conversations. Its perspectives and suggestions are generated automatically from the content submitted by the user.

Important: TextCalm AI does not provide medical or psychological advice, diagnosis, treatment or therapy. AI-generated analyses are automated suggestions and may be incomplete, inaccurate or unsuitable for your situation. They do not replace advice from a qualified healthcare or mental-health professional. If you are experiencing psychological distress or immediate danger, contact local emergency services, a qualified professional or an appropriate crisis helpline.

2. Access and subscriptions

Basic use of TextCalm AI does not require an account. Some features are reserved for Premium subscribers. See our Terms of Sale.

3. Acceptable use

You must use the application lawfully. You must not use it to harass or unlawfully monitor another person, infringe third-party rights, compromise the service, bypass its security controls or submit content you are not entitled to process.

4. Intellectual property

Thibault Demars owns, or is authorised to use, the intellectual-property rights in the application's software, design, text, logos, icons and other protected elements.

5. Liability

TextCalm AI is provided subject to applicable statutory guarantees. We do not guarantee that AI-generated analyses will be accurate, complete or appropriate in every situation. Users remain responsible for their decisions and communications. Nothing in these terms excludes or limits liability where doing so would be prohibited by applicable law.

6. Availability and changes

We may modify, suspend or discontinue all or part of the service. Where this materially affects an active paid subscription, reasonable notice will be provided when required by applicable law.

7. Ending use

You may stop using the application at any time. Subscription cancellation and store refunds are managed through your App Store or Google Play account, as explained in the Terms of Sale.

8. Governing law

These terms are governed by French law. This choice does not deprive consumers of mandatory protections granted by the law of their country of residence. Before going to court, consumers may use the free consumer mediation service described in section 7 of the Terms of Sale (CM2C). Any dispute will be submitted to the courts having jurisdiction under applicable consumer law.
